Abstract
The program is implemented by the Kyiv Economics Institute and is supported by the United States Agency for International Development (USAID). The program's primary objective is to make the legal environment in Ukraine more favorable for PPP development. During the second quarter of Year 5 (Y5Q2), P3DP staff implemented almost all activities as planned. A considerable progress was achieved under Objective 1, with three draft laws being adopted in the first reading. The draft laws include the "On Amendments to Some Laws on PPPs" and the "On Energy Efficiency of Buildings" laws. P3DP provided proposals and recommendations to the Ukrainian officials and parliamentarians on these draft laws, which contributed to their adoption. P3DP also worked on the development of the Draft CMU Decree on amendments to the Decree #81 on PPP contracts performance monitoring. The amendments provide sound regulations, eliminate current contradictions in the legislation, and provide flexibility for the parties in identifying the form and essence of contract performance monitoring. Additionally, P3DP participated in the SWM Strategy Group meetings to support developments in the solid waste management area. The program's performance indicators for Objective 1 include the adoption of draft laws and the development of CMU decrees. The target indicators for the first three objectives are likely to be met, with the greatest risk of underimplementation being for POI 2.5 (project ideas submitted by local governments to MoEDT) due to local elections. P3DP's activities under Objective 1 include monitoring the legal environment, providing proposals and recommendations to Ukrainian officials and parliamentarians, and supporting the development of CMU decrees. The program's progress under Objective 1 is significant, with three draft laws being adopted in the first reading and the development of the Draft CMU Decree on amendments to the Decree #81. The program's performance indicators for Objective 2 include the development of analytical documents related to POI 2.2, 2.3, and 2.4. P3DP participated in several meetings with people's deputies lobbying the adoption of the Draft Law #1058 "On Amendments to Specific Laws of Ukraine" regarding elimination of regulatory barriers for PPP development in Ukraine and investment promotion. The draft law was adopted by the parliament in the first reading, and P3DP submitted a finalized version of the draft for the second reading based on stakeholders and experts' feedback. P3DP's activities under Objective 2 include providing support to the Draft Laws on amendments to the Budget Code (on energy efficiency and long-term budget commitments) and tracking and supporting the processing and adoption of these drafts. The program's progress under Objective 2 is significant, with the adoption of the Draft Law #1058 and the submission of a letter of support for the Draft Laws #1313 and #1409 on ESCO implementation and Budget Code amendments. The program's performance indicators for Objective 3 include the development of analytical documents related to POI 3.1, 3.2, and 3.3. P3DP participated in the SWM Strategy Group meetings to support developments in the solid waste management area. The Draft Law #2010 "On Amendments to Some Laws On Competitiveness Conditions for Electricity Production from Alternative Resources of Energy" was submitted to the VR by people's deputies and registered in the parliament. The draft law amends existing legislation by improving methods of energy payment calculations for enterprises. P3DP's activities under Objective 3 include providing support to the Draft Laws on amendments to the SWM laws and tracking and supporting the processing and adoption of these drafts. The program's progress under Objective 3 is significant, with the submission of the Draft Law #2010 and the participation in the SWM Strategy Group meetings.
