Abstract
The law aimed to improve the quality of electricity supply in the Federation of Bosnia and Herzegovina. Key amendments included the addition of new articles to the Law on Electricity, which focused on institutional protection of end-customer rights, monitoring of the safety and reliability of the distribution network, and the adoption of regulations on the quality of supply. The amendments also introduced new requirements for the distribution system operator, including the maintenance and improvement of the quality of supply, performance of voltage quality measurements, and the preparation and publication of a report on the quality of supply. Additionally, the law introduced new penalties for non-compliance with the obligations related to the quality of electricity supply. The Energy Permit is an administrative act issued by the FBiH Ministry of Energy, Mining, and Industry (FMERI) during the process of obtaining all required permits for construction and/or reconstruction of an electric power facility. The permit confirms that the project is compliant with all conditions set out in legislative and regulatory acts of FBiH, and which ensure safe operation of the electrical network, environmental protection, energy efficiency, and other. The issuance of the Energy Permit is regulated by several acts, including the Law on Electricity in Federation of Bosnia and Herzegovina, the Law on FBiH administrative fees and the rates of FBiH administrative fees, and the Regulation on the Procedure, Criteria, Form, and Content of the Application for the Issuance of Energy Permits for Construction of New and Reconstruction of Existing Generation Capacities. The FBiH Ministry of Energy, Mining, and Industry (FMERI) is competent for issuing the Energy Permit. The permit is obtained for all generation facilities, regardless of the type or installed power of the facility. The Energy Permit is obtained before the permit for construction of new or reconstruction of existing electric power facilities is obtained. The one-time administrative fee for issuing the Energy Permit is determined by the Decision on the one-time Administrative Fee for the Consideration of the Energy Permit Application. The fee varies depending on the installed power of the facility, ranging from BAM 200.00 for micro power plants to BAM 5,000.00 for large power plants. The fee can be paid via a payment order or a special stamp. An application for the Energy Permit is submitted to FMERI in writing on the prescribed form, accompanied by additional forms, including the Financial indicators, Questionnaire for the applicant, and Statement on the accuracy of data.
