A bank guarantee, known as the BiH Bank Guarantee, has been issued to Elektroprenos-Elektroprijenos a.d., a company based in Banja Luka, Bosnia and Herzegovina. The guarantee is in the amount of Convertible Marks, with an expiry date of an unspecified date. The guarantee is provided by a bank, which has its headquarters and registered address at an unspecified location. The guarantee is issued in accordance with the Rulebook on the Allocation of Rights for the Use of Cross-Border Transmission Capacities. The bank undertakes to pay up to a maximum of Convertible Marks upon receipt of a written request from the beneficiary, stating that the amount claimed has fallen due and that the client has failed to fulfill its obligations. The demand for payment must be received no later than the expiry date, and the guarantee will become null and void at the expiry date. The guarantee is governed by the law of Bosnia and Herzegovina, and the place of jurisdiction is unspecified. The bank may only be released from the obligations under the terms of the guarantee before the expiry date if the beneficiary gives its written consent.
