Abstract
The program was designed to address core aspects of Kosovo's commercial justice system, including the resolution of commercial disputes in court, the capacity and readiness of judges and court staff, the professionalism of private enforcement agents, and the availability of alternative dispute resolution mechanisms. To achieve its objectives, the program focuses on three main areas: strengthening Kosovo's capacity to resolve commercial disputes and enforce judgments, enhancing commercial law and the use of alternative dispute resolution mechanisms, and improving public awareness and legal literacy. The program's activities are designed to support reforms in these areas, with the ultimate goal of improving businesses' and the public's perceptions about corruption. The program's activities are divided into several activity areas, each with specific objectives and tasks. Activity Area 1.1 aims to strengthen Kosovo's capacity to resolve commercial disputes and enforce judgments, with a focus on improving the resolution of commercial disputes in court. This includes conducting a Commercial Litigation Rapid Assessment (CLRA) and advocating for reforms to court-based commercial litigation. Activity Area 1.2 focuses on training commercial judges, staff, and business support professionals. This includes conducting a Training Needs Assessment (TNA) for commercial law training and supporting the development of a commercial law training curriculum. Activity Area 1.3 aims to improve accountability, reliability, and professionalism of private enforcement agents, with a focus on supporting the strengthening of accountability systems and developing the capacity of the Chamber of Private Enforcement Agents. Activity Area 1.4 aims to improve business perceptions of commercial justice, with a focus on conducting commercial justice and business roundtables and measuring perceptions of corruption in commercial justice. Activity Area 2.1 focuses on enhancing commercial law and the use of alternative dispute resolution mechanisms, with a focus on supporting the development of arbitration and mediation. Activity Area 2.2 aims to enhance commercial legislation, with a focus on supporting the unification of commercial legislation. The program's performance during the quarter was generally positive, with several key activities completed or underway. The Commercial Litigation Rapid Assessment (CLRA) was conducted, and a training needs assessment was completed for commercial law training. The Chamber of Private Enforcement Agents was also strengthened, with a focus on improving accountability and professionalism. Several significant activities are planned for the next quarter, including the development of a commercial law training curriculum and the implementation of a mediation case referral system. The program's adaptive management and learning approach will continue to guide its activities, with a focus on monitoring and evaluating progress towards its objectives. The program's indicators and tracking system will continue to be used to monitor progress towards its objectives. The indicators include measures of commercial dispute resolution, commercial law and alternative dispute resolution mechanisms, and public awareness and legal literacy. The tracking system will be used to monitor progress towards these indicators, with a focus on identifying areas for improvement and adjusting the program's activities accordingly.
