Abstract
The views expressed in this publication do not necessarily reflect the views of the United States Agency for International Development or the United States Government. The report was submitted by the Business Plus Initiative Project (BPI) Project/Chemonics International Inc. in June 2012, Ulaanbaatar, Mongolia. The main author is George M. Reider, and the report is a result of the BPI Project, which aimed to support the development of the insurance industry in Mongolia. The report focuses on the Mandatory Drivers' Liability Insurance Program, which was implemented to ensure that drivers in Mongolia have adequate insurance coverage. The program was established to address the challenges faced by the insurance industry in Mongolia, including the lack of regulatory oversight and the need for effective implementation of the Mandatory Drivers' Liability Insurance Law. Public education is identified as a key challenge in the implementation of the program. The report recommends that the Financial Regulatory Commission (FRC) and the insurance industry work together to educate the public about the importance of mandatory drivers' liability insurance. Implementation of the program is also a critical issue. The report notes that the FRC has a responsibility to ensure that insurance companies provide credible service and protection to their policyholders and that the industry remains solvent. The report recommends that the FRC regulators be alert to possible outcomes, such as rate adequacy issues, and be prepared to react thoughtfully and quickly. The report also discusses the rate structure, dialogue between the regulator and the industry, data bank, actuarial capacity development, reinsurance, guarantee association, guidelines for claims, dispute resolution, drivers' insurance fund, and improving drivers' safety. These topics are critical to the effective implementation of the Mandatory Drivers' Liability Insurance Program. The report concludes that the greatest challenge in implementing the program is not in the laws and regulations, but rather in their implementation. The report recommends that the FRC and the insurance industry work together to address the challenges and ensure the successful implementation of the program. The report includes an annex on the Insurance Guarantee Association Insight, which provides additional information on the insurance industry in Mongolia. The report is a valuable resource for policymakers, regulators, and industry stakeholders who are interested in understanding the challenges and opportunities associated with implementing the Mandatory Drivers' Liability Insurance Program in Mongolia. The report highlights the importance of effective regulatory oversight and the need for the FRC to work closely with the insurance industry to ensure the successful implementation of the program. The report also emphasizes the need for public education and awareness about the importance of mandatory drivers' liability insurance. The report provides a comprehensive analysis of the Mandatory Drivers' Liability Insurance Program in Mongolia and offers recommendations for its successful implementation.
