Abstract
on May 7, 2013. The program aims to address a range of challenges in Kosovo's court system, including the reduction of the judgment caseload, support to the Ministry of Justice (MOJ) to implement the new Private Enforcement Agent (PEA) system, and enforcement of contracts. The program focuses on three main components: Improved Systems for Enforcement of Judgments and Reduction of Backlog in Enforcement Cases, Development of the Contract/Commercial Law Framework and Systems, and Outreach, Gender, and Monitoring. The first component involves reducing the backlog of enforcement cases in the Kosovo court system, improving systems for statistics related to execution caseload, and supporting Basic Courts with backlog reduction activities. The second component focuses on developing the contract/commercial law framework and systems, improving contract enforcement systems, and expanding mediation mechanisms. This includes implementing the Law on Obligations, amending the Law on Business Organizations, and developing a new Law on Mediation. The program also supports the University of Pristina Faculty of Law to improve the skills of future commercial lawyers and coordinates with the Assembly of Kosovo on drafting and amending laws related to economic development and rule of law. The third component involves outreach, gender, and monitoring activities, including conducting outreach on the new enforcement system, backlog reduction, and mediation. The program also conducts outreach with the business community and other related activities. As of the end of the reporting period, January 31, 2016, the CLE program reported an 82.28% reduction of the execution caseloads in the seven Basic Courts and the recovery of over 5,826,338 Euro of previously unrecovered judgment debt. The CLE program has made significant progress in reducing the backlog of enforcement cases and improving the enforcement of contracts in Kosovo. The program's efforts have resulted in the recovery of a substantial amount of judgment debt and have contributed to the improvement of the commercial legislation in Kosovo. The program's continued support to the Ministry of Justice and the courts will be crucial in maintaining the momentum of these efforts and ensuring the long-term sustainability of the reforms.
