Abstract
Between 1997 and 2017, the ECHR issued 354 judgments in Moldovan cases, finding 503 violations of human rights. The most frequently violated rights include the right to a fair trial (Article 6 of the European Convention on Human Rights), the prohibition of torture (Article 3), the right to liberty and security (Article 5), and the right to an effective remedy (Article 13). The most common types of violations include the non-execution of court judgments, defective investigation of maltreatment and deaths, detention in poor conditions, and the revocation of irreversible court judgments through annulment or irregular application of revision. Maltrreatment and insufficient motivation for arrest are also frequently reported. The right to a fair trial (Article 6) is the most frequently violated right, with 156 violations, accounting for 31% of all violations. The right to liberty and security (Article 5) is the second most frequently violated right, with 72 violations, accounting for 14.3% of all violations.
