Abstract
The project focuses on clarifying the structure and substance of contracts to ensure non-discriminatory treatment and efficient energy transactions. The typical energy transaction involves three separate transactions: the Supplier delivering energy to the Transco, the Transco delivering energy to the DSO, and the DSO delivering energy to the Eligible Customer. Each transaction requires addressing key issues, including the amount and timing of energy delivery, points of interconnection, and consequences for losses or imbalances. The contract between the Supplier and Eligible Customer establishes the terms for purchase and sale of energy, including amounts, price, and timing of delivery. The contract between the Supplier and Transco addresses the scheduling of energy delivery, treatment of imbalances, and points of interconnection. The contract between the ISO and the BRP (Balancing Responsible Party) covers the points of receipt and delivery of energy, transmission tariffs, and scheduling of energy delivery. The contract between the DSO and Supplier addresses points of interconnection, scheduling of energy delivery, distribution tariffs, and billing and collection responsibilities. The draft contract templates between Supplier and Eligible Customer, and the DSO and Supplier, encompass these elements and contain standard contract language concerning performance and default. The project's focus on developing contract forms aims to ensure efficient and non-discriminatory energy transactions in BiH. The draft contract templates provide a starting point for revising and refining the contracts, and the project's outcome will contribute to the development of a well-functioning energy market in BiH.
