Abstract
These standards are based on public expectations regarding the quality of court services and court performance indicators, such as the duration of proceedings and the specific weight of adjudicated cases. A court that meets these standards can be considered excellent according to the international framework of court excellence. The aim of court performance evaluation is to improve the organization of court operations, increasing the effectiveness, efficiency, and quality of judicial procedures. This evaluation is not intended to assess the performance of individual judges but rather to provide court leadership with information to inform strategic decisions and prioritize changes. Court performance evaluation allows court leadership to obtain information about the current situation in the court, justify current and strategic decisions, determine priorities for changes, monitor innovations, and evaluate their productivity and efficiency. International experience in the field of court performance evaluation has identified major components of this process, including court performance standards, criteria, indicators, and evaluation methods. Court performance standards are quantitative and qualitative characteristics of court operations developed according to basic values of the judiciary and democratic society. Court performance criteria are substantial distinctive features of court performance that serve as a basis for performance evaluation procedures. Court performance indicators are quantitative or qualitative data that identify the level of conformity of court operations to established quality criteria. Evaluation methods are a complex of standard research means and ways of collecting, processing, and analyzing court performance data. The European Commission for the Efficiency of Justice (CEPEJ) plays a significant role in monitoring and evaluating court performance in the Council of Europe member states. CEPEJ emphasizes the importance of monitoring and evaluation as tools for measuring situations, assessing policy implementation outcomes, and allocating resources. CEPEJ recommends periodic evaluation and monitoring of the quality of justice and court performance in the Council of Europe member states. The CEPEJ 2014 report highlights the importance of developing a policy of performance quality of courts and justice systems, introducing new monitoring and evaluation tools, and promoting the quality of justice and courts. CEPEJ has developed and implemented various tools for monitoring and evaluating court performance, including a Checklist for promoting the quality of justice and courts, a Handbook for conducting satisfaction surveys aimed at court users, and a Questionnaire for collecting information on the organization and accessibility of court premises. The CEPEJ 2014 report also notes that 25 countries, including Ukraine, do not have established court performance standards, while 22 countries have established such standards. This trend indicates a growth in the number of Council of Europe member states establishing court performance standards.
