Abstract
The process begins with the formation of an initiative group, which is responsible for preparing and conducting the establishment of the OSBB. The initiative group must prepare a package of documents for registration, including the statute, protocol of the establishment of the OSBB, and a statement. The statute is a fundamental document that outlines the structure, powers, and responsibilities of the OSBB, as well as the rights and obligations of co-owners. The initiative group must also gather information about the co-owners, including their contact details and the characteristics of their apartments or other premises. This information can be obtained from the co-owners themselves, the State Register of Immovable Property Rights, or the Bureau of Technical Inventory. The initiative group must also conduct an informational and explanatory work among the co-owners, explaining the purpose and benefits of creating an OSBB. This includes holding meetings and providing information about the OSBB, its structure, and its functions. The establishment of the OSBB is formalized through the adoption of a resolution by the co-owners, which is recorded in a protocol. The resolution must be adopted by a majority of the co-owners, and it must specify the name of the OSBB, its statute, and the composition of its governing bodies. Once the OSBB is established, it must be registered with the relevant authorities, and it must obtain a seal and open a bank account. The OSBB is considered to be a legal entity from the moment of its registration, and it is responsible for managing the common property and finances of the building. The OSBB is a voluntary association of co-owners, and it is not a state institution. However, it has the power to make decisions on behalf of the co-owners and to manage the common property and finances of the building. The OSBB is also responsible for ensuring that the building is maintained and repaired, and that the co-owners comply with the rules and regulations of the building. In Ukraine, the creation of an OSBB is governed by the Civil Code and other relevant laws and regulations. The OSBB must comply with these laws and regulations, and it must also follow the principles of transparency, accountability, and fairness in its decision-making and management processes. The OSBB can be dissolved or reorganized through a decision of the co-owners, and it can also be liquidated in the event of bankruptcy or other financial difficulties. The OSBB must also comply with the requirements of the State Register of Immovable Property Rights and the Bureau of Technical Inventory. In summary, the creation of an OSBB in Ukraine involves several steps, including the formation of an initiative group, the preparation of a package of documents for registration, the gathering of information about the co-owners, and the conduct of informational and explanatory work among the co-owners. The OSBB is a voluntary association of co-owners, and it is responsible for managing the common property and finances of the building.
