Abstract
These projects were presented to the Commission of Women and Family, which provided favorable opinions on many of them. One of the key projects was the modification of the Código Civil (Civil Code) to clarify the concept of "suspensión de patria potestad" (suspension of parental authority) in cases of marital breakdown. This project, presented by Luisa María Cuculiza, aimed to harmonize the Civil Code with the Código de los Niños y Adolescentes (Code of Children and Adolescents) and consolidate the shared custody established by Law No. 29269. Another project, presented by Aldo Bardalez, proposed modifying the Civil Code to guarantee the right to identity of children born to married women whose fathers are not their husbands. This project aimed to address the current presumption of paternity in the Civil Code, which violates the child's right to identity. The Commission of Women and Family also considered projects related to the protection of children and adolescents. For example, a project presented by Juan Carlos Eguren proposed modifying the Code of Children and Adolescents to incorporate principles and freedoms of children and adolescents, in line with international human rights treaties ratified by Peru. In addition, the Commission examined projects related to women's participation in decision-making positions. For instance, a project presented by María del Carmen Omonte proposed establishing a quota of 30% for women in the directorates of private companies, while another project presented by Gladys Oseda proposed modifying the Civil Code to make the action for payment of pensions imprescriptible. The Commission also considered projects aimed at preventing violence against women and children. For example, a project presented by the Executive Power proposed modifying the Law of Protection against Family Violence to grant probative value to medical-legal certificates and psychological evaluations in cases of family violence. Furthermore, the Commission examined projects related to women's political participation and protection against political harassment. For example, a project presented by Verónika Mendoza proposed defining acts of political harassment, establishing penalties for such acts, and providing measures to prevent them. In terms of family law, the Commission considered projects related to adoption and the rights of children. For example, a project presented by Juan José Díaz proposed modifying the Law that grants Labor License for Adoption to protect the family and equate the rights of biological children with those of adopted children. Finally, the Commission examined a project related to the protection of mother adolescents, presented by Gladys Oseda. This project aimed to establish the protection of mother adolescents in two areas: health and education. These legislative projects demonstrate the Commission of Women and Family's commitment to promoting women's rights and addressing issues related to family and children in Peru.
