Abstract
The Block Temático de la Ley de Municipios was developed with the members of the comisión de la Ley de Municipios, who conducted several work sessions to analyze and understand the anteproyecto de Ley. The Licenciado Miguel Ángel Mencias, representative of APROHCAFE and member of the comisión de incidencia política, socialized the anteproyecto de ley with Diputados from the sector cafetalero. The Block Temático de la Ley de Descentralización Hacia los Municipios was shared by the personal of the Secretaría de Interior y Población-UTD, who presented the document contentivo del anteproyecto de ley to the other members of the comisión. The alcaldes members of the comisiones socialized the document with different mancomunidades. The Block Temático de la Ley de Carrera Administrativa Municipal was socialized with the members of the comisión for analysis. A meeting was held on June 12 with the Presidente de la Comisión de Asuntos Municipales II del Congreso Nacional, Ingeniero Marcio Vega, and the members of the comisión de incidencia. Although the diputado emphasized the need for the will of the alcaldes and diputados, as there is opposition from municipalidades that maintain sindicatos. The Block Temático de la Reforma a la Ley General del Ambiente involved two work sessions between técnicos of SERNA and AMHON to construct a proposal for reforma to the Ley General del Ambiente. The borrador was then discussed with técnicos from the Municipalidades that currently have descentralizado licenciamiento ambiental. FOPRIDEH, as support for the process of incidencia político led by AMHON and SERNA, contracted the services of the Abogado Izaguirre to elaborate a document of reforma in coherence with the anteproyecto de Ley de Municipios and Descentralización. During the period of vacaciones del Congreso Nacional, the Alcaldes members of the comisiones de incidencia política of AMHON will convene the Diputados from each of the Departamentos to work sessions to socialize the anteproyectos de ley. This process will be accompanied by the representatives of the afiliadas of FOPRIDEH where there is representation. Approaches were made with the periodistas and comunicadores sociales from the zona de occidente, norte, and centro of the country to give an inducción in the temas of Descentralización and autonomía municipal that are being impulsed in the Congreso Nacional by SEIP, AMHON, and FOPRIDEH. The sector ONGD currently faces several limitations that go beyond the high demand and limited offer of resources from international cooperation to finance social programs and projects for the development of the country. The sector ONGD, in addition to financial limitations, is affected in many cases by the lack of knowledge of our labor and functioning by the Government, which has resulted in discretionary practices by officials that have worn down the organizations in tedious and slow procedures. The Ley Especial de Fomento para las Organizaciones No Gubernamentales de Desarrollo and its reglamento were approved, which aims to improve the situation of the sector ONGD. A comisión especial was formed between the sector ONGD and legal advisors of the SEIP to coordinate the elaboration of the borrador of the Reglamento de la ley. The process was extensive, and five versions of borradores were obtained before achieving a consensuado document between the parties. The anteproyecto de reglamento was sent to the Procuraduría General de la República for dictaminación, and the document was then turned over to the Secretaria de la Presidencia for a final review. The sector ONGD remained attentive, and FOPRIDEH conducted several follow-up meetings with the Secretario de Estado in the Despachos del Interior and Población, with his legal advisors, with the President Lobo, and with the Secretario General del Despacho Presidencial. The Reglamento de la Ley Especial de Fomento para las Organizaciones No Gubernamentales de Desarrollo defines the procedure and functioning of the ONGD, with clear rules on the requirements of the content of the statutes that the SEIP can demand in the constitution of the organizations, establishes causes and procedures for suspension and cancellation, and regulates the economic activities without profit for the sustainability of the organizations. The sector ONGD's next challenge is to influence the reforms of the tributary law to ensure that the nature of the juridical and social benefit
