Abstract
This system is rooted in the traditional laws and customs of the indigenous peoples, which are based on their cosmovision and cultural practices. The JEI is recognized by the Colombian Constitution, which established the principle of multiculturalism and the right of indigenous peoples to exercise their own jurisdiction. The Constitution also established the obligation of the State to provide forms of articulation and coordination between the JEI and the Sistema Judicial Nacional (Sistema Judicial Nacional). The JEI is composed of various elements, including the personal, territorial, institutional, and objective elements. The personal element refers to the individuals who exercise jurisdiction within the JEI, while the territorial element refers to the geographical area within which the JEI operates. The institutional element refers to the institutions and authorities that are responsible for administering the JEI, and the objective element refers to the specific laws and regulations that govern the JEI. The JEI has several limitations, including the need for coordination with the Sistema Judicial Nacional and the need to ensure that the rights of indigenous peoples are respected. The JEI also faces challenges related to the conflict armado, desplazamiento forzado, aislamiento geográfico, pobreza, extrema miseria, precarias condiciones de salud y nutrición, barreras lingüísticas, desconocimiento de los sistemas propios de justicia, and recurrentes conflictos de competencias entre la JEI y el Sistema Judicial Nacional. To address these challenges, the Colombian government has implemented various initiatives, including the creation of Casas de Justicia, Sistemas Locales de Justicia, and a Banco de Iniciativas y Proyectos. These initiatives aim to improve access to justice for indigenous peoples, promote the exercise of their own jurisdiction, and ensure that their rights are respected. The JEI is an important mechanism for promoting the rights of indigenous peoples in Colombia, and its consolidation is essential for ensuring that these rights are respected and protected. However, the JEI faces significant challenges, and its effectiveness depends on the ability of the Colombian government to provide adequate support and resources. The Colombian government has recognized the importance of the JEI and has taken steps to promote its development. However, more needs to be done to address the challenges facing the JEI and to ensure that it is effective in promoting the rights of indigenous peoples. The Colombian government must continue to work with indigenous communities to develop and implement policies that promote the exercise of their own jurisdiction and ensure that their rights are respected. The JEI is a complex system that requires careful consideration of the cultural, social, and economic context of indigenous communities. Its development and implementation must be based on a deep understanding of the needs and aspirations of these communities, and must take into account the challenges and obstacles that they face. By working together, the Colombian government and indigenous communities can develop a system of justice that is effective, efficient, and respectful of the rights of indigenous peoples.
