Abstract
The General Conditions aim to improve the efficiency, security, and fairness in the delivery and supply of natural gas, as well as to ensure transparent and non-discriminatory behavior of entities in the natural gas sector. The General Conditions define the rights and obligations of the supplier and the final customer. The supplier's rights include the right to invoice and collect amounts owed in accordance with the General Conditions of Supply and the contract with the customer, to suspend delivery in cases of noncompliance with the contractual obligations by the customer, and the right to compensation for damages caused by the customer's action or omission. The supplier's obligations include concluding a supply contract with the customer, delivery of gas in the prescribed way and in accordance with the contracted conditions, billing and collection, and making the General Conditions of Supply available to the customer. The General Conditions also define the rights and obligations of the final customer. The customer's rights include the right to receive gas of the prescribed quality, to be informed about the conditions of gas supply, and to have access to the General Conditions of Supply. The customer's obligations include paying for the gas supplied, adhering to the terms and conditions of the supply contract, and cooperating with the supplier in the implementation of the General Conditions. The quality of gas is a critical aspect of the General Conditions. The gas supplier is responsible for delivering gas that meets the prescribed quality standards. The General Conditions also regulate the conditions of billing and collection of the delivered gas, including the mandatory content of the bill and the procedures for billing and collection. Measures for the protection of final customers are also an essential part of the General Conditions. The General Conditions provide for the right of final customers to file complaints and to have their complaints addressed in a timely and fair manner. The General Conditions also regulate the procedures for extraordinary billing, control billing, and correction of billing and bill for delivered gas. Monitoring of the application of the General Conditions is another critical aspect of the General Conditions. The General Conditions provide for the establishment of a monitoring system to ensure that the General Conditions are applied in a fair and transparent manner. The monitoring system is responsible for monitoring the implementation of the General Conditions and for reporting any non-compliance to the relevant authorities. The General Conditions also provide for transitional and final provisions, including the interpretation of the General Conditions, the entry into force, and the amendment of the General Conditions. The General Conditions are intended to improve the efficiency, security, and fairness in the delivery and supply of natural gas in the FBiH and Brčko District, and to ensure transparent and non-discriminatory behavior of entities in the natural gas sector.
