Abstract
The program's objective is to regulate emissions of greenhouse gases (GEI) of anthropogenic origin, as well as actions for mitigation and adaptation to climate change. Additionally, the program aims to define the concurrence between the three orders of government: the Federation, the entities, and the municipalities. The program's regulatory framework is based on the Ley General de Cambio Climático (LGCC), which requires the establishment of a federal regulation. The study aimed to identify the elements that need to be regulated, harmonize with other federal regulations, and analyze the main economic instruments. A matrix was created to outline the provisions of the LGCC. The program identified several key areas that require regulation and harmonization, including the Programa de Ordenamiento Ecológico General del Territorio, the Programa para la protección y manejo de la biodiversidad ante el CC, and the Fondo para el Cambio Climático. The program also established a timeline for the implementation of these regulations, with many of the deadlines falling in 2012 and 2013. The Fondo para el Cambio Climático, for example, required the establishment of a trust fund, the approval of the rules of operation by the Comité Técnico, and the installation of the Comité Técnico. The Estatuto Orgánico del INECC and the ENCC also required regulation, including the establishment of procedures for public consultations and the selection of social advisors. The program also identified the need for regulations related to the elaboration, updating, and publication of the inventory of greenhouse gas emissions, as well as the procedures for inscription of mitigation projects in the registry. Additionally, the program required the establishment of methodologies for the monitoring, reporting, and verification (MRV) of emissions, as well as the identification and elaboration of reforms to existing legal and administrative orders. The program also established a timeline for the selection of social advisors, with a public call for the selection of these advisors to be made by the end of September 2013. The selection of these advisors was to be completed by the end of December 2013.
