Abstract
The initiative is a collaboration between the Fundación Saraki and the United States Agency for International Development (USAID) to increase the willingness and capacity of the public and private sectors to provide inclusive education opportunities. The project focuses on four key areas of work: conceptualization and promotion of an inclusive vision of education, accompaniment of the Ministry of Education and Culture (MEC) in the development of a guiding model, empowerment of society and establishment of an observatory of inclusive education with trained leaders, and promotion of inclusive sports by developing strategies for its development in schools. The introduction of the document explains that it aims to provide a simple and accessible overview of disability, inclusion, and the laws that promote justice, equity, and equal rights for persons with disabilities in Paraguay. The document seeks to contribute to the construction of an inclusive society that recognizes the value of all individuals and allows for their participation in all aspects of society. The document defines disability as the result of the relationship between a person with limitations or deficiencies and the obstacles in the environment that prevent them from participating in social life like other people. The document lists several laws that promote inclusion in Paraguay, including: * Ley Nº 3.540/08, which ratifies the Convention on the Rights of Persons with Disabilities and establishes its superior status to national laws. * Ley Nº 2.479/04 and Ley Nº 3.585/08, which establish the obligation of public institutions to incorporate at least 5% of persons with disabilities into their workforce. * Ley Nº 4.616/12, which establishes the reservation of preferential places for persons with physical or motor disabilities in theaters, cinemas, and sports stadiums. * Ley Nº 4.720/12, which creates the Secretaría Nacional por los Derechos Humanos de las Personas con Discapacidad (SENADIS), an institution responsible for transversalizing the theme of disability in public institutions and their policies. * Decreto Nº 10.514/13, which regulates the Ley Nº 4.720/12 and creates the Comisión Nacional por los Derechos de las Personas con Discapacidad (CONADIS). * Ley Nº 4.934/13, which establishes the obligation of public and private services to have the necessary infrastructure to allow persons with disabilities to access them. * Ley Nº 4.962/13, which provides fiscal incentives to private companies that hire persons with disabilities. * Ley Nº 5014/13, which requires bars, cafes, and restaurants to provide menus in braille for persons with visual disabilities. * Ley Nº 5.136/13, which establishes the obligation of public and private schools to include persons with disabilities and provide them with the necessary support to study. * Decreto 5507/16, which establishes the Plan de Acción Nacional por los Derechos de las Personas con Discapacidad, a commitment by the Paraguayan State to implement actions that ensure persons with disabilities can enjoy their rights fully.
