Abstract
The Gallup Coexist Index 2009 report highlights the significance of religion in international development, emphasizing its role in shaping attitudes, behaviors, and social norms. This understanding underscores the importance of incorporating religious perspectives and actors in USAID's programming. The development objective of USAID's religious engagement initiatives must be clearly defined, secular in purpose, and serve as the foundation of all programming. This objective is essential in ensuring that USAID's activities and programs are effective, efficient, and aligned with the agency's overall mission. The First Amendment's Establishment Clause, which prohibits the establishment of a religion or the prohibition of its free exercise, has significant implications for USAID's programming. The agency must adhere to the Government Corporation (GC) Guidance, which outlines the legal requirements for USAID-financed activities and programs. These requirements include ensuring that programs have a secular purpose, do not advance or inhibit religion, and do not result in government indoctrination of religion. USAID-financed activities and programs must also be allocated on the basis of neutral, secular criteria that neither favor nor disfavor religion. This means that assistance must be made available to both religious and secular beneficiaries on a nondiscriminatory basis. The agency must avoid creating an excessive entanglement with religion, defining its recipients by reference to religion, or using religious criteria to determine eligibility for assistance. In evaluating the legality of specific activities, USAID must consider whether they pass the legal guidelines outlined in the GC Guidance. This involves assessing whether the activity has a secular purpose, does not advance or inhibit religion, and meets the other requirements outlined in the guidance. By adhering to these guidelines, USAID can ensure that its programming is effective, efficient, and compliant with the law. The agency's ability to engage with religious actors and incorporate their perspectives into its programming is critical to achieving its development objectives. By doing so, USAID can build trust, foster collaboration, and leverage the resources and expertise of religious communities to address development challenges. However, this engagement must be done in a way that is consistent with the agency's legal obligations and the principles of neutrality and secularism.
