Abstract
Central and local self-government agencies act as owners of land on behalf of the Ukrainian people. The land in Ukraine can belong to private, state, and communal ownership. Village, town, and city councils manage communally-owned lands, while local state administrations manage lands located beyond the boundaries of populated areas. The main tasks for local governments in the area of land relations include commissioning and funding works to determine and demarcate the boundaries between populated areas, inventory and registration of lands, economic valuation of lands, control over the use and protection of communally-owned lands, meeting needs of physical and legal persons in land parcels, and resolution of land disputes. The responsibility to maintain the State Land Cadastre is given to the central executive agency for land resources and its territorial offices. The current legal framework for local government activities in the technical area of land management is governed by various laws and regulations. The Land Code of Ukraine #2768-III of October 25, 2001, is the primary law governing land management in Ukraine. Other relevant laws include the Civil Code #435-IV of January 16, 2003, the Law of Ukraine "On Land Fee" #2535-XII of July 03, 1992, and the Law of Ukraine "On Local Self-Governance in Ukraine" #280/97-ВР of May 21, 1997. The laws and regulations governing land management in Ukraine are supplemented by resolutions of the Constitutional Court of Ukraine, which provide official interpretations of the provisions of the Land Code of Ukraine and other laws. The resolutions also address issues related to land disputes, land auctions, and the use of land plots. Additionally, the Cabinet of Ministers of Ukraine has issued various resolutions and orders that provide guidance on land management procedures, including the procedures for buying out land plots, changing the designation of lands, and preparing land management documents. Regulatory documents of state executive agencies, such as the State Committee on Land Resources and the Ministry of Justice, also play a crucial role in governing land management in Ukraine. These documents provide instructions on establishing boundaries of land plots, securing them by landmarks, and streamlining relations on issuing excerpts from the registry of immovable property rights. Overall, the land management sector in Ukraine is governed by a complex set of laws, regulations, and guidelines that aim to ensure the efficient and effective use of land resources.
