Abstract
The Probate Court is responsible for the probate of wills, administration of estates, and the registration of land documents. The court's primary function is to ensure that land transactions are conducted in a transparent and accountable manner. The study on the Probate Court's involvement in land transactions in Liberia was conducted by the University of Liberia-Pacific Institute for Research and Evaluation (UL-PIRE) in collaboration with the Liberia Monitoring and Evaluation Program (L-MEP). The study aimed to assess the Probate Court's role in land transactions, identify challenges, and provide recommendations for improvement. The study found that the Probate Court's involvement in land transactions is critical, particularly in the registration of land documents. The court officials reported that the Probate Court's primary function is to ensure that land transactions are conducted in a transparent and accountable manner. However, the study also identified several challenges, including the lack of public awareness of the Probate Court's functions and the procedures required for probating land documents. The study revealed that the Probate Court's procedures for probating land documents are complex and time-consuming, requiring multiple steps and interactions with various stakeholders. The court officials reported that the public is often unaware of the procedures required for probating land documents, leading to delays and disputes. The study also found that the Probate Court's fees for probating land documents are often high, making it difficult for individuals to access the court's services. The study recommended that the Probate Court should take steps to improve public awareness of its functions and procedures. The court should also simplify its procedures for probating land documents and reduce its fees to make it more accessible to the public. Additionally, the study recommended that the Probate Court should establish a system for tracking and monitoring land transactions to ensure transparency and accountability. The study's findings and recommendations have significant implications for the Probate Court's role in land transactions in Liberia. The court's involvement is critical for ensuring that land transactions are conducted in a transparent and accountable manner. However, the court's procedures and fees must be simplified and reduced to make it more accessible to the public. By implementing the study's recommendations, the Probate Court can improve its services and contribute to the development of Liberia's land sector. The study's methodology involved a survey of court officials, public respondents, and senior managers of the Department of Lands, Surveys, and Cartography (DSCL) and the Center for National Deeds and Records/Archives (CNDRA). The survey aimed to assess the Probate Court's role in land transactions, identify challenges, and provide recommendations for improvement. The study's findings are based on the survey results and provide valuable insights into the Probate Court's functions and procedures. The study's recommendations are aimed at improving the Probate Court's services and contributing to the development of Liberia's land sector. The recommendations include simplifying the court's procedures for probating land documents, reducing its fees, and establishing a system for tracking and monitoring land transactions. By implementing these recommendations, the Probate Court can improve its services and contribute to the development of Liberia's land sector.
