Abstract
This framework is based on several laws and regulations, including Undang-Undang Nomor 31 Tahun 2004 tentang Perikanan, which has been amended by Undang-Undang Nomor 45 Tahun 2009. Additionally, Peraturan Pemerintah Nomor 60 Tahun 2007 tentang Konservasi Sumberdaya Ikan and Peraturan Menteri KP Nomor 61 Tahun 2018 tentang Pemanfaatan Jenis yang dilindungi dan/atau Jenis Ikan yang tercantum dalam Appendiks CITES provide further guidance on the conservation of marine resources. The Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) is also an important framework for the trade of protected marine species. Indonesia has ratified CITES and has established regulations to implement its provisions, including Peraturan Menteri KP Nomor 5 Tahun 2018 tentang Larangan Pengeluaran Hiu Koboi (Carcharhinus longimanus) dan Hiu Martil (Sphyrna spp.) dari Wilayah Negara Republik Indonesia ke Luar Wilayah Negara Republik Indonesia. Peraturan Menteri KP Nomor 4 Tahun 2014 tentang Penetapan Status Perlindungan Penuh Pari Manta also provides protection for the manta ray. The Indonesian government has also established procedures for the issuance of recommendations for the trade of protected marine species. Peraturan Direktur Jenderal Pengelolaan Ruang Laut Nomor 13/PER-DJPRL/2018 tentang Tata Cara Penerbitan Rekomendasi Perdagangan Jenis Hiu dan Pari provides guidance on the issuance of recommendations for the trade of sharks and rays. Additionally, Peraturan Direktur Jenderal Pengelolaan Ruang Laut Nomor 20 Tahun 2017 tentang Pedoman Penyelenggaraan Pelayanan Publik di Lingkungan Direktorat Jenderal Pengelolaan Ruang Laut provides a framework for the provision of public services, including the issuance of recommendations for the trade of protected marine species. The Indonesian government has also established procedures for the issuance of certificates of origin for the trade of coral and fish. Memorandum Plt. Direktur Jenderal Pengelolaan Ruang Laut Nomor 12/DJPRL/I/2020 tentang Penerbitan Surat Keterangan Ketertelusuran (SKK) Pengankutan Koral/Karang Hias provides guidance on the issuance of certificates of origin for the trade of coral and fish. Additionally, Standar Operasi Prosedur Nomor 01/DJPRL.5/OT.310/1/2020 tentang Pemberian Surat Keterangan Ketertelusuran Koral/Karang Hias Hasil Transplantasi provides guidance on the issuance of certificates of origin for the trade of coral and fish that have been transplanted. The Indonesian government has also established a system for the online submission of applications for recommendations and certificates of origin. The system, known as SIRJIKAN, allows applicants to submit their applications online and track the status of their applications. The system is accessible through the website https://erekomendasi-denpasar.kkp.go.id. Applicants can submit their applications and track the status of their applications through the system.
