Abstract
The law's objectives include attributing responsibilities to state agencies and municipalities, defining principles and instruments of the policy, ensuring informed participation of citizens, and establishing inspection and enforcement mechanisms. The law's structure is divided into five titles. Title I, Disposiciones Generales, outlines general provisions and definitions. Title II, Autoridades, establishes the roles and responsibilities of the Governor, Secretariat of Sustainable Development, and municipalities. Title III, Política Estatal en Materia de Cambio Climático, defines the state's climate change policy and establishes the Estrategia Estatal, a guiding instrument for the policy. The Estrategia Estatal is the instrument rector of the state's climate change policy, outlining the content, procedure for its issuance, and revision and update processes. The law also establishes the Programa Estatal, which sets state-level objectives, goals, and priorities, as well as the Programas Municipales, which set municipal-level objectives, goals, and priorities. The law emphasizes the importance of coordination and concertation among state agencies, municipalities, and civil society. It also establishes the principle of "who pollutes pays," ensuring that those responsible for environmental degradation are held accountable. The law's implementation is expected to promote an economy of low CO2 emissions, sustainability, and congruence between economic and environmental development. The law's provisions also include the creation of a Comisión Intersecretarial, a coordinating body responsible for implementing the state's climate change policy. The law requires the establishment of a Consejo Consultivo, a consultative body that will provide advice on climate change policy and implementation. The law's enforcement mechanisms include inspection and vigilance, measures of security, and sanctions for non-compliance.
