Abstract
The anteproyecto aims to update and unify the existing legislation related to the structure and functions of the Consejo de la Magistratura. The current legislation governing the Consejo de la Magistratura is fragmented, with eight laws regulating its functioning in a specific manner. The anteproyecto proposes to consolidate these laws into a single comprehensive body of norms. The proposal is based on the experience gained in the past years, which has shown that despite significant advances in the strengthening of the Consejo de la Magistratura, there is still a long way to go to consolidate the independence of the Poder Judicial. The anteproyecto proposes several novelties in relation to the existing legislation, including the integration of the Consejo de la Magistratura with the Poder Judicial, with autonomy functional and administrative, and autarquía presupuestaria. This design is consistent with the fact that the Constitution recognizes and regulates the Consejo de la Magistratura in the same chapter of the Título II (De la estructura y de la organización del Estado) of the Parte Orgánica, corresponding to the Poder Judicial. The anteproyecto also proposes the elimination of the members suplentes, as they can be in the exercise of the profession of abogados, cargos públicos, or even cargos político-partidarios, which is inadmissible and contrary to the objective of preserving the independence of the Poder Judicial. The proposal also includes mechanisms for the rapid and effective integration of new members in case of vacancies. The anteproyecto is the result of an exhaustive analysis developed between February and July 2021, which includes the existing legislation, anteproyectos presented in the Congreso Nacional, results of mesas de trabajo, and interviews with actors directly concerned. The proposal is presented as a comprehensive and updated body of norms that aims to consolidate the independence of the Poder Judicial and to strengthen the Consejo de la Magistratura. The anteproyecto is divided into several chapters, including the Exposición de Motivos, which explains the reasons for the proposal, and the Presentación del anteproyecto de Ley del Consejo de la Magistratura para su consideración. The proposal also includes several annexes that provide additional information and supporting documents. The anteproyecto is a significant step towards the consolidation of the independence of the Poder Judicial and the strengthening of the Consejo de la Magistratura. It is a comprehensive and updated body of norms that aims to address the existing gaps and inconsistencies in the existing legislation and to provide a clear and coherent framework for the functioning of the Consejo de la Magistratura.
