Abstract
367-012 was signed on September 22, 2009, between the United States of America and the Government of Nepal. The agreement aimed to support the Government of Nepal in building and sustaining a democratic, well-governed state that responds to the needs of its people and reduces widespread poverty. The six objectives of the agreement were: Peace and Security, Governing Justly and Democratically, Investing in People, Economic Growth, Humanitarian Assistance, and Program Development and Program Administrative Costs. To achieve these objectives, the parties agreed to work together to achieve progress against the indicators described in Annex 1, Amplified Description. The USAID contribution to the agreement was an amount not to exceed $40,720,292, with a total estimated contribution of $205,000,000. The Grantee, the Government of Nepal, agreed to provide or cause to be provided all funds and other resources required to complete the activities necessary to achieve the objectives. The Grantee's contribution was based on USAID's contribution and was not less than the equivalent of one-fourth of the portion of the Grant that was used to support activities that directly benefited the Grantee. The completion date for the agreement was September 30, 2014, or such other date as the parties may agree to in writing. Requests for disbursement, accompanied by necessary supporting documentation, were to be received by USAID no later than nine months following the completion date. After this period, USAID may give notice in writing to the Grantee and reduce the amount of the Grant. Prior to the first disbursement under the Grant, the Grantee was required to furnish to USAID an opinion of counsel and a signed statement designating additional representatives. USAID would promptly notify the Grantee when the conditions precedent had been met. The terminal date for meeting the conditions specified was 30 days from the date of the agreement or such later date as USAID may agree to in writing. The agreement also included special covenants, such as the requirement for the Grantee to provide necessary documents and to comply with procurement and disbursement procedures. The parties agreed to communicate with each other in a timely and effective manner and to designate representatives to act on their behalf. Annex 1, Amplified Description, further described the objectives and indicators that would be used to measure progress and achievement in each of the objectives. The annex may be changed by written agreement of the authorized representatives of the parties without formal amendment of the agreement.
